About These Terms
These Terms and Conditions ("Terms") apply to the card payment introduction and setup service provided by Jake Wells, trading as JW Card Machines, a sole trader ("I", "me", "my"). By requesting a quote or commissioning a setup, whether by phone, email or through the website, you agree to these Terms.
1. The Service
JW Card Machines helps small businesses and tradespeople get set up taking card payments, personally, through an established payment platform. I act as an introducer: I help you understand what's on offer, put together your free quote or comparison, and support you through getting set up — the underlying card processing itself is provided by a regulated third-party payment platform (Section 7), not by me directly.
What's Not Included
I don't provide banking services, hold your funds, or act as a payment institution myself. Anything relating to the processing, settlement or regulation of your payments is governed by the payment platform's own terms, which you'll be asked to accept separately as part of onboarding.
2. Getting a Quote
A free, no-obligation quote can be requested by phone, email, or through the contact form. If you already take card payments and want a comparison, I'll ask for your current provider and approximate rate — the accuracy of the comparison depends on the accuracy of what you tell me. There's no charge and no commitment for a quote or comparison, whichever applies to you.
3. Pricing
Your transaction rate is confirmed as part of your individual free quote, based on your business and how you take payment — there's no advertised headline rate, because a generic figure rarely reflects what a specific business actually pays. Any cost of continuing to use the machine beyond the first 12 months, if any applies, will be made clear in your quote well before it's due — there's still no contract tying you in, and you're free to stop at any time.
- Your quote will always be given to you in writing before you're asked to go ahead
- Accepted payment methods for anything payable to me directly will be confirmed at the time of booking
- Any fees, charges or rates set by the payment platform itself are set out in its own terms, not these Terms
4. Onboarding & the Payment Platform
Getting set up involves an application to the payment platform that will actually process your card payments. As part of this, you'll need to provide accurate business and identity information for their standard checks (know-your-customer and anti-money-laundering checks are a legal requirement for all UK card payment providers, not something specific to JW Card Machines). I'll help you through this, but the payment platform makes its own decision on whether to accept an application, and its own terms govern the processing relationship once you're set up.
5. Payouts
Payouts are next-day, every day, including weekends and bank holidays, as standard with the payment platform used. This depends on the payment platform's own processing and your bank's receipt of funds, both of which are outside my direct control — while next-day payouts are the standard and expected outcome, I can't guarantee timing in circumstances outside the payment platform's or my reasonable control (for example, a banking system issue or a hold placed by the platform for standard fraud-prevention reasons).
6. Cancellation
There's no contract and no minimum term — you can stop using the machine and close your account with the payment platform at any time, following the platform's own straightforward closure process. If you cancel a request for a quote or a setup in progress before it's completed, no fee is due to me. Returning any free machine provided as part of the first-year offer, if requested, will be discussed reasonably at the time.
7. Card Scheme Rules & Your Responsibilities
As the merchant, you're responsible for complying with the card scheme rules (Visa, Mastercard, Amex and so on) and the payment platform's own terms — including handling refunds, chargebacks and disputes correctly, keeping cardholder data secure in line with PCI DSS requirements that apply to any business taking card payments, and making sure information given to me or the payment platform is accurate and lawful.
8. Intellectual Property
Any copy, quote documents or materials I prepare for you as part of setup remain mine to reuse in a general form for other clients, though nothing containing your specific business or financial details is ever shared. Unless you ask me not to, I may mention that I've worked with your type of business as a general example — never your name or figures without asking first.
9. Liability
Reasonable care and skill are always used in putting together your quote and helping you get set up. I'm not liable for the payment platform's own decisions, service, fees or downtime, for losses arising from inaccurate information you provided, or for factors outside my reasonable control. My liability for any claim relating to the introduction or setup service is limited to any fees paid to me directly for that service.
10. Data Protection
Any personal or business data collected as part of a quote, comparison or setup is handled in line with the Privacy Policy, which forms part of these Terms. Some of that information will also be shared with the payment platform as part of your application — see Section 4 and the Privacy Policy for more detail.
11. Complaints
If you're ever unhappy with any part of the introduction or setup service, please get in touch directly and it will be addressed as quickly as possible: jake@jwcardmachines.co.uk or 07452 752398. A complaint about the processing service itself, once set up, is usually handled fastest by the payment platform directly, and I'll always help point you the right way.
12. Changes to These Terms
These Terms may be updated from time to time. Any significant change will be communicated directly to anyone with an active arrangement through me. The "Last updated" date above reflects the most recent version. Continuing to use the service after a change means the updated Terms are accepted.
13. General
Governing law: these Terms are governed by the laws of England and Wales. Entire agreement: these Terms, together with the Privacy Policy and anything specifically agreed at the time of booking, form the entire agreement between us regarding the introduction and setup service — separately, the payment platform's own terms govern the processing relationship once you're set up. Severability: if any part of these Terms is found to be unenforceable, the rest continues to apply as normal.
